1. Agreement to Terms

2. Brokerage and Advisory Capacity
MyCommercialFunding is a commercial funding brokerage and advisory consultant. We are not a direct lender, bank, or deposit-taking financial institution. We assist business owners by compiling application materials, identifying potential alternative capital partners (including merchant cash advance and revenue-based funding entities), and negotiating financing options on your behalf.
3. Accuracy of Application Data
You agree that all information, revenue figures, bank statements, and personal identification details you submit through our funnels or to our advisors are complete, truthful, and accurate. Submitting falsified information or altered bank statements is a violation of these terms and may lead to immediate termination of service and referral to appropriate credit bureaus or authorities.
4. No Guarantee of Approvals
While we strive to secure funding offers for all qualified candidates, MyCommercialFunding does not guarantee that your application will be approved by our lender network. All lending and funding decisions are made solely by the respective direct lenders based on their proprietary underwriting criteria, monthly revenue thresholds, and risk matrices.
5. Intellectual Property
All content, logo designs, custom widgets, calculators, and graphics on this Site are the property of MyCommercialFunding and are protected by United States copyright, trademark, and intellectual property laws. Unauthorized reproduction of any elements is strictly prohibited.
6. Limitation of Liability
To the maximum extent permitted by law, MyCommercialFunding, its founder Richard McKellar, and its employees shall not be liable for any direct, indirect, incidental, or consequential damages resulting from your use of the Site, any funding arrangements made through our brokerage, or your business's subsequent financial performance.
7. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to conflict of law principles. Any legal actions arising from these terms shall be filed in the courts of Morris County, New Jersey.
8. Modifications
